March 31, 2009—The CPSC announced that Yamaha Motor Co has agreed to suspend sales of its Rhino 450, 660 and 700 off-road recreational vehicles.

The vehicles are prone to rollover during normal driving. In fact, the CPSC noted that many of the accidents "involve[d] turns at relatively low speeds and on level terrain.

Federal Government Launches Probe of Yamaha Rhino

 

November 4, 2008—Federal safety regulators with the Consumer Product Safety Commission announced it was investigating the Yamaha Rhino following reports of some 30 deaths involving the all-terrain vehicle.

Yamaha faces more than 200 lawsuits from people alleging the vehicle is unstable. For its part, Yamaha blames the accidents on driver error or vehicle modifications.

Because the Yamaha Rhino is neither classified as an ATV nor a vehicle, there are no regulations in place to assure safety of occupants. O'Steen & Harrison is committed to ensuring that Yamaha take reasonable steps to protect users of its vehicle.

February 8, 2008—Attorneys Paul Friedman and Jonathan O'Steen filed suit on behalf of an Arizona resident who was seriously injured when the vehicle he was operating rolled over while negotiating a turn. When the vehicle tipped, the driver's leg was pinned underneath.

The Complaint alleges the vehicle is unreasonably dangerous and Yamaha knew or should have known that the vehicle was defective. The case is proceeding in Maricopa County Superior Court.

The Yamaha Rhino is marketed as a side-by-side all-terrain vehicle. The tendency of the Rhino to rollover during normal use has resulted in serious injuries and death.

Drivers and passengers have sustained injuries including crushed limbs, severed limbs, crushed and perforated organs and broken bones.

The Yamaha Rhino has several design flaws that make it unreasonably dangerous, including a high center of gravity, small tires and narrow wheel base. The changes announced by Yamaha in August 2007 do not address these serious issues.

Experts have questioned the safety of the Yamaha Rhino since its release. In August 2007, Yamaha announced that it would add doors and passenger handles to vehicles manufactured after 2004, but stopped short of issuing a recall of the Rhino.

At the same time, Yamaha issued a new product warning label for the Yamaha Rhino that acknowledged the risk of rollover accidents and alerts users that the Rhino can rollover even while operating the vehicle on flat, open areas.

In spite of its knowledge of serious injuries resulting from rollover accidents, Yamaha has not announced a recall of the Rhino all-terrain vehicle. Yamaha has, however, initiated a retrofit program for 2004–07 Rhino models that includes doors, new warnings and supplemental handholds.

Yamaha President Injured in Rhino Rollover

In July 2002, Keisuke ("Casey") Yoshida, president of a U.S. subsidiary of Yamaha Motor Co. Ltd., injured his foot when the Yamaha Rhino he was driving rolled over.

At a company meeting a few weeks later, Mr. Yoshida questioned the safety of the Yamaha Rhino. The minutes from the meeting read "Casey wants update on stability of vehicle for future liability cases." These concerns about future liability came even before the release of the vehicle.
